Rental Contract Terms

1) Ownership: During the rental period the instrument remains the property of Hammond Ashley Violins.

2) Payment: Rental shall be payable monthly in advance each month. Payment is made via automatic credit card, debit card, or e-check charges.

3) Termination: Contract is terminated upon satisfactory return of all items on rental contract and payment of past due rent and damage fees or deductibles.

4) Damage, Loss: Parties listed as “Customer” and “Spouse” are responsible for all damage or loss to the items on this contract. Damage plans are available to cover loss or damage during the term of this contract. Please inquire about Accidental Damage and Loss plan.

5) Instrument Repair and Maintenance: Hammond Ashley Violins must perform all repair or maintenance to items listed on the contract. Standard workshop rates will apply to items not covered under the Accidental Damage and Loss agreement.

6) Change Of Address: It is agreed that Customer shall notify Hammond Ashley Violins as to any change of address.

7) Insurance: An instrument being rented is the responsibility of the customer, i.e. the parent/guardian of a child or the individual of legal age. Please ask for information about insurance.

8) Purchase Discount: In the event the Customer shall buy from Hammond Ashley Violins, this, or any other instrument of the same class (violin = violin) while this rental contract is in good standing, there shall be applied upon the purchase price thereof, 100% of the first 9 months rent.

9) Past Due Accounts: A late charge of $5.00 per month may be charged on all accounts that are 10 days or more past due. Failure to return an instrument 30 days or more past due may result in the account being turned over to a collection agency with purchase price added to past due account balance, or it may result in repossession plus rental due and all late charges. Should an individual fail to return a past due instrument, there will be a repossession charge of $25.00 plus any legal or collection fees necessary to recover said instrument. Failure to promptly return rented property may result in Criminal Prosecution.

10) Credit Card Authorization: The Customer authorizes Hammond Ashley Violins to: Prepare and submit credit charge slips using any of the charge cards listed in the application to recover all charges and other unpaid amounts due to (a) failure of Customer to return items (b) damages to returned items and (c) other unpaid charges (rental fees, late charges, amount of returned checks and maximum lawful charge thereof, plus reasonable legal fees).
